Terms of Service

1. Agreement

By booking a session or using any service provided by IMAGE MIAMI ("we," "us," "our"), you ("Client") agree to be bound by these Terms of Service. Please read them carefully before proceeding.

2. Booking & Payment

A non-refundable retainer of 50% of the agreed session fee is required to confirm and hold your booking date. The remaining balance is due on or before the day of the session. All fees are quoted in USD.

3. Cancellation & Rescheduling

Cancellations made more than 7 days before the session date will forfeit the retainer. Cancellations within 7 days of the session date are subject to the full session fee. Rescheduling requests made more than 72 hours in advance will be accommodated once at no additional charge, subject to availability.

4. Intellectual Property

All photographs and videos created by IMAGE MIAMI remain the intellectual property of IMAGE MIAMI. Upon receipt of full payment, the Client receives a non-exclusive, non-transferable license to use the delivered images for the purposes agreed upon in writing. Resale, sublicensing, or commercial redistribution requires a separate written agreement.

5. Delivery

Edited deliverables will be provided within the timeframe agreed at booking (standard: 5–7 business days). Expedited delivery may be available for an additional fee. All files are delivered via a private online gallery link.

6. Portfolio Use

Unless the Client requests otherwise in writing prior to the session, IMAGE MIAMI reserves the right to display select images in its portfolio, website, and social media for promotional purposes.

7. Limitation of Liability

In the unlikely event of equipment failure, accident, or circumstances beyond our control, IMAGE MIAMI's liability is limited to a refund of fees paid. We are not liable for incidental or consequential damages.

8. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved exclusively in the courts of Miami-Dade County, Florida.

Acknowledgment & Consent
By making a booking, submitting a retainer payment, or otherwise engaging IMAGE MIAMI for photographic or video services — whether in writing, verbally, or electronically — you confirm that: (a) you are at least 18 years of age, or are acting with the full legal authority of a parent or guardian; (b) you have read and understood these Terms of Service in their entirety; and (c) you agree to be legally bound by them. These Terms constitute a binding agreement between you and IMAGE MIAMI and supersede any prior understandings, representations, or agreements, whether oral or written.
