IMAGE MIAMI Photo Release

1. Overview
This Photo Release explains when and how IMAGE MIAMI may photograph, film, publish, display, distribute, and otherwise use images, video, names, likenesses, voices, captions, professional titles, links, and related event or session information.
This Photo Release applies to IMAGE MIAMI events, event coverage, business portrait sessions, private sessions, gift invitation sessions, partnership features, online galleries, social media publications, advertising and promotional materials, editorial features, and other IMAGE MIAMI services or experiences.
By booking, purchasing, participating in, attending, or appearing in an IMAGE MIAMI shoot, event coverage, session, gallery, or feature, you agree to this Photo Release unless IMAGE MIAMI has agreed otherwise in writing before the service.
2. Relationship to Other IMAGE MIAMI Terms
This Photo Release should be read together with the IMAGE MIAMI Privacy Policy, Cookie Policy, Terms of Service, Booking Terms & Service Agreement, Photo Usage Rights, Gift Certificate Terms, and Event Photography Notice, as applicable.
If there is a conflict between this Photo Release and a written agreement signed or expressly confirmed by IMAGE MIAMI for a specific private session, event, partnership, or commercial production, that specific written agreement will control for that service.
3. Permission to Use Images and Likeness
You grant IMAGE MIAMI permission to capture, edit, publish, display, reproduce, distribute, license, archive, and otherwise use selected photographs, videos, recordings, names, likenesses, voices, captions, professional titles, company names, social media handles, website links, event information, and related content in connection with IMAGE MIAMI’s services, portfolio, website, online galleries, social media, editorial content, advertising, marketing, promotional materials, partnership pages, press, presentations, and other business purposes.
This permission includes use in digital, print, social media, advertising, editorial, portfolio, gallery, promotional, partnership, and brand materials, whether now known or later developed, unless a narrower use has been agreed in writing before the service.
4. Public Events and Event Coverage
For public, semi-public, hosted, sponsored, ticketed, venue-based, corporate, networking, community, partnership, or promotional events covered by IMAGE MIAMI, attendees understand that photography and/or video may take place and that attendees, guests, organizers, speakers, sponsors, performers, staff, venue representatives, and other participants may appear in published event coverage.
Images from public or semi-public event coverage may be published in IMAGE MIAMI galleries, event recaps, editorial features, social media, organizer or partner pages, promotional materials, advertising, and portfolio materials without obtaining individual written approval from every attendee, unless required by law or unless IMAGE MIAMI has agreed otherwise in writing.
Event organizers are responsible for communicating any event-specific photography restrictions, VIP privacy requirements, venue rules, guest restrictions, or sponsor limitations to IMAGE MIAMI before the event.
By attending an event where IMAGE MIAMI is providing photography or media coverage, guests acknowledge that photography and/or video may take place and that images may be used for event galleries, editorial coverage, portfolio, social media, website, and promotional purposes related to the event, organizer, venue, or IMAGE MIAMI.
5. Private Sessions
Private sessions, including proposals, birthdays, family sessions, private portraits, personal celebrations, and other non-public sessions, may receive a higher level of privacy. IMAGE MIAMI may provide password-protected galleries, limited sharing, private delivery, or other privacy settings when available and when agreed.
Unless IMAGE MIAMI has agreed in writing before the session that the session is private or not for public use, IMAGE MIAMI may use selected images from private sessions for portfolio, website, social media, editorial, promotional, marketing, advertising, partnership, and brand purposes.
Clients who want a private session, no public posting, limited publication, delayed publication, or restricted use must request and receive written confirmation from IMAGE MIAMI before the session.
6. Business Portraits and Professional Sessions
For business portraits, executive portraits, team sessions, corporate content, founder features, brand sessions, and professional visibility projects, IMAGE MIAMI may use selected images, names, titles, company names, captions, links, and related professional information to showcase the work, identify the subject, describe the project, create editorial or partnership features, and promote IMAGE MIAMI’s services.
The client receives usage rights as described in the Photo Usage Rights document, but IMAGE MIAMI and/or the photographer retain the copyright and portfolio rights unless otherwise agreed in writing.
7. Organizer-Provided Information and Special Guests
Event organizers, partners, venues, sponsors, or authorized representatives may provide names, titles, company names, speaker information, guest information, social media handles, website links, captions, logos, or other public or professional information for use in event pages, galleries, articles, guest highlights, or partnership features.
IMAGE MIAMI may review, edit, approve, decline, or remove organizer-provided information at its discretion. Organizers are responsible for ensuring they have the right to submit information about special guests, speakers, sponsors, performers, team members, or other participants.
8. Online Galleries and Gallery Access
IMAGE MIAMI may deliver images through online galleries. Galleries may be public, unlisted, private, password-protected, download-enabled, viewing-only, watermarked, branded, or limited in access depending on the event, session, package, organizer request, and IMAGE MIAMI’s settings.
Password protection, private links, or limited access are additional protective measures but do not guarantee absolute confidentiality. Clients and organizers are responsible for controlling how they share gallery links, passwords, downloaded images, ZIP files, screenshots, and other media.
9. Downloads, ZIP Files, Watermarks, and Sharing
When downloads are enabled, clients, guests, organizers, or approved users may be able to download individual images or ZIP archives. IMAGE MIAMI may choose whether downloads are available for a specific gallery, event, session, or package.
Some images may include a watermark, logo, credit, brand mark, or other identifying element. Users may not remove, crop out, obscure, alter, or misrepresent watermarks, credits, copyright notices, logos, or metadata unless IMAGE MIAMI agrees in writing.
10. AI, Automation, Face-Based Gallery Tools, and Search
IMAGE MIAMI may use trusted software tools, automation, image analysis, face-based grouping, face-based search, visual matching, tagging, or similar technologies to help organize media, prepare galleries, improve delivery, help guests find images, support editing workflows, and improve the client experience.
These tools may analyze visible features in images or video. IMAGE MIAMI does not use face-based gallery tools for legal identity verification, government identification, financial eligibility decisions, employment eligibility decisions, law enforcement identification, or third-party advertising targeting based on facial templates.
Where required by applicable law, IMAGE MIAMI will honor valid requests to restrict, remove, or opt out of certain face-based features, subject to technical limits, event context, already published materials, legal obligations, organizer agreements, and other reasonable limitations.
11. Advertising, Marketing, and Promotional Use
The permission granted in this Photo Release includes the right for IMAGE MIAMI to use selected images, videos, names, likenesses, captions, and related content in marketing, advertising, promotional campaigns, social media posts, paid ads, retargeting creatives, website pages, landing pages, portfolio materials, sales presentations, partnership pages, email marketing, and similar materials.
IMAGE MIAMI will use reasonable judgment when selecting materials and does not intend to publish images in a false, misleading, defamatory, offensive, adult, unlawful, or highly sensitive context.
12. No Additional Compensation
Unless IMAGE MIAMI has agreed otherwise in writing, you understand and agree that you will not receive additional payment, royalties, approval rights, inspection rights, or other compensation for IMAGE MIAMI’s use of images, videos, names, likenesses, captions, or related content under this Photo Release.
13. Editing and Creative Control
IMAGE MIAMI has creative control over image selection, editing, retouching, cropping, color treatment, sequencing, captions, gallery structure, publication timing, portfolio selection, and promotional use. IMAGE MIAMI may decide which images are delivered, published, withheld, removed, archived, watermarked, or featured.
IMAGE MIAMI may decline to publish, may remove previously published images, or may restrict access to images at its discretion.
14. Minors
If a person appearing in a session, event, gallery, or publication is under the age of majority, a parent, legal guardian, organizer, school, venue, or other authorized representative may need to provide consent depending on the nature of the event, session, and applicable law.
For private sessions involving minors, the booking client represents that they have the authority to provide the permissions required for the session and related image use, unless IMAGE MIAMI has agreed otherwise in writing.
15. Removal, Restriction, or Privacy Requests
Individuals, clients, organizers, or authorized representatives may contact IMAGE MIAMI to request removal, restriction, correction, or limited use of a specific image, video, name, likeness, caption, link, or gallery item. IMAGE MIAMI will review such requests in good faith.
IMAGE MIAMI may not be able to guarantee removal from materials already printed, downloaded, shared by third parties, indexed by search engines, published by organizers or partners, distributed through social media, included in backups, or otherwise outside IMAGE MIAMI’s direct control.
16. No Transfer of Copyright
This Photo Release gives IMAGE MIAMI permission to use images, video, likenesses, and related content. It does not transfer copyright ownership to the client, organizer, guest, or participant. Copyright ownership and client usage rights are addressed in the IMAGE MIAMI Photo Usage Rights document and any applicable written agreement.
17. Limits Required by Law
Nothing in this Photo Release is intended to limit rights that cannot be limited under applicable law. Where applicable law requires additional consent, specific notice, parental consent, withdrawal rights, opt-out rights, or other safeguards, IMAGE MIAMI will apply this Photo Release in a manner consistent with those legal requirements.
